Child Support

Child support questions are common when a couple is getting divorced. Each side will want to know that the children are being cared for financially. We can help you understand and resolve all aspects of child support, including modification of child support orders.

Both parents are responsible for financially supporting their children. Minnesota uses an “income shares model” based on each parent’s gross income to determine each parent’s obligation to provide financial support to their children. Child support is based primarily upon each parent’s income and the amount of time each parent spends with the child, along with several other factors.

Some of the items that go into the child support calculation include:

  • Basic child support – day-to-day expenses
  • Medical support (health and dental insurance and expenses)
  • Child care support (daycare expenses)
  • Education expenses

Modification of Child Support

Child support may be modified if there has been a substantial change in circumstances that renders the existing child support order unreasonable or unfair. Changed circumstances could include increased or decreased earnings of a parent, a change in parenting time or custody schedules, a subsequent born child, or emancipation of a child.
